Passport for a Child without Custody

We got a reader question asking about getting a passport for a child if you don't have custody. In this case, the person wanting to apply for the passport is a biological parent.

When applying for a passport for a child, it doesn't matter who the biological parents of the child are, it matters who currently has custody of the child. This is to keep a parent who has lost custody from getting a passport and taking their child out of the country.

If a biological parent who doesn't have custody wants a passport for a child, they must appear with a notarized letter of consent from the person with custody.
